• Cybersecurity assessment, defense-in-depth implementation, and SOC operations support.
• DevOps integration, CI/CD pipeline design, GitOps workflows, and infrastructure-as-code development.
• Technical advisory services, architecture reviews, and ongoing engineering support.

The specific scope, deliverables, timeline, and fees for any professional engagement are governed by a separate written agreement or statement of work executed between Jin Ming and the client. These Terms govern general website usage and do not supersede any provisions in separately executed service agreements. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice, provided that such changes do not affect obligations under active client engagements.

3.0 Intellectual Property Rights

All content, materials, and intellectual property displayed on or made available through the Jin Ming website — including but not limited to text, graphics, logos, icons, images, code, software, design elements, trade names, and trademarks — are the exclusive property of Guangzhou Jinming Network Technology Co., Ltd. or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws of China and international conventions.

The Jin Ming name, the J logo mark, and jinming.hair domain are trademarks of Guangzhou Jinming Network Technology Co., Ltd. You may not use, reproduce, or display these trademarks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and view the content on our website for personal, non-commercial purposes only. You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, content, or materials obtained from our website without our express written consent.

For client engagements, ownership of deliverables, work product, and intellectual property created during the course of a professional engagement is governed by the terms of the separate service agreement between Jin Ming and the client.

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

6.0 Indemnification

You agree to defend, indemnify, and hold harmless Guangzhou Jinming Network Technology Co., Ltd., its parent, subsidiaries, affiliates, and their respective officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys fees and legal costs) arising out of or related to:

• Your violation of any provision of these Terms.
• Your violation of any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
• Your violation of any applicable law, rule, or regulation.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these Terms or any transactions conducted in connection with our Services.

Any legal action, suit, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts located in Guangzhou, Guangdong Province, China. You agree to submit to the personal jurisdiction of such courts and waive any objection to venue or forum non conveniens.

For clients located outside China, certain mandatory consumer protection laws of your jurisdiction may apply and these Terms do not limit any rights you may have under such laws.

8.0 Dispute Resolution

We believe that most disputes can be resolved through direct communication. Before initiating any formal legal proceedings, you agree to first contact us at hello@jinming.hair and attempt to resolve the dispute informally. We will also attempt to resolve the dispute informally by contacting you.

If a dispute cannot be resolved through informal negotiation within thirty (30) days, either party may pursue resolution through the following means:

• Mediation: The parties may agree to submit the dispute to mediation administered by a recognized mediation center in Guangzhou, China. Mediation shall be conducted in Chinese or English, as agreed by the parties.
• Arbitration: If mediation is unsuccessful or not elected, the dispute shall be referred to and finally resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC) in accordance with its arbitration rules in effect at the time. The seat of arbitration shall be Guangzhou. The arbitration shall be conducted in English. The arbitral award shall be final and binding on both parties.

Notwithstanding the foregoing, Jin Ming reserves the right to seek injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights, without the requirement of posting a bond or proving actual damages.

9.0 Termination

These Terms shall remain in full force and effect while you use our website or Services. We may terminate or suspend your access to our website and Services at any time, with or without cause, with or without notice, effective immediately.

Grounds for termination may include, but are not limited to:

• Your breach of any provision of these Terms.
• Conduct that we believe is harmful to other users, our business, or third parties.
• Your request for termination of your relationship with Jin Ming.
• Discontinuation or material modification of the Services.
• Compliance with legal obligations or requests from law enforcement or regulatory authorities.

Upon termination, your right to access and use our website and Services shall cease immediately. The following provisions shall survive termination: Intellectual Property Rights (Section 3.0), Limitation of Liability (Section 5.0), Indemnification (Section 6.0), Governing Law (Section 7.0), Dispute Resolution (Section 8.0), and any other provisions that by their nature should reasonably survive termination.

Termination of these Terms does not affect any rights or obligations that have accrued prior to the date of termination, nor does it affect any ongoing professional engagements governed by separate written agreements.
